Consumer Protection Issues Covered by the DTPA
The Texas Deceptive Trade Practices Act (DTPA) protects consumers from “false, misleading, or deceptive acts or practices”. A consumer who prevails may obtain the amount of actual damages found by the trier of fact. In addition the court shall award two times that portion of the actual damages that does not exceed $1000.00. If the trier of fact finds that the conduct of the defendant was committed knowingly, the trier of fact may award not more than three times the amount of actual damages in excess of $1000.00. Each consumer who prevails shall also be awarded court costs and reasonable and necessary attorney fees. The DTPA grants broad consumer protection rights to individuals and businesses. It applies to consumer transactions involving fraud or misrepresentations such as the following:
- Refusal to repair or replace defective products
- Failure to perform contracted services
- Failure to honor a warranty (either written or implied)
- Failure to disclose known defects or safety hazards
- Selling used goods as “new”
- Imposing phantom fees and surcharges
- Charging for unnecessary parts or repairs
- Failure to perform paid-for repairs
- Failing to disclose information
